قاعدة فيما يفطر الصائم وما لا يفطره
وهذا نوعان: منه ما يفطره بالنص والإجماع، وهو الأكل والشرب والجماع، قال الله تعالى: {فالآن باشروهن وابتغوا ما كتب الله لكم وكلوا واشربوا حتى يتبين لكم الخيط الأبيض من الخيط الأسود من الفجر ثم أتموا الصيام إلى الليل}، فأذن في المباشرة، فعقل من ذلك أن المراد الصيام من المباشرة والأكل والشرب.
